Terms of Service

These terms govern your use of OpenToPoach. Please read them — they describe what we do with your work, what you can expect from the AI, and what we ask of you.

1. These terms

OpenToPoach (“OpenToPoach”, “we”, “us”) provides an AI-assisted platform that helps professionals present their experience and helps recruiters discover talent. By creating an account or using the service you agree to these terms. If you don't agree, don't use the service.

Our Privacy Policy explains what we do with personal data and forms part of these terms.

2. Your account

You must be at least 16 and able to enter a contract. Keep your login secure — activity under your account is your responsibility. One account per person; don't share it, and don't create an account for someone else or pretend to be them.

3. What the service does

  • For candidates — you can build a master résumé, generate versions of it tailored to specific roles, score how you appear to recruiters, develop your professional brand, and optionally list yourself in a directory where recruiters can find you.
  • For recruiters — you can post roles, see ranked matches among candidates who have opted in, and contact them through the platform.

4. Your content

Your résumé, writing samples, and everything else you add stay yours. You give us permission to store and process them only so far as we need to run the service for you — generating what you ask for, scoring your profile, and showing what you choose to publish.

You are responsible for what you put in. You confirm that your content is accurate, that it's yours to share, and that sharing it doesn't breach anyone else's rights or an obligation you owe someone (an employment contract or NDA, for example).

5. AI-generated material

Much of what the service produces — tailored CVs, write-ups, posts, scores — is generated by AI models, some run by third parties. Two things matter here, and we want to be precise about both.

  • What we do guarantee. When we generate a tailored CV, we check it against your own master résumé and reject any output containing a claim, figure, or detail that doesn't trace back to something you wrote. The system reframes your material; it is designed not to invent new facts about you.
  • What we can't guarantee. We do not verify whether your underlying résumé is true. That check compares output to your input — it cannot tell us whether the input was accurate in the first place. AI output can also be imperfect, awkward, or wrong in judgement. Read anything before you send it, and correct it if it's wrong. You remain responsible for every claim you present as your own.

6. Recruiter-generated tailored CVs

If you list yourself in the directory, a recruiter searching with a specific role can generate a version of your CV framed for that role. We tell you this at the point you list, and you can decline it there or switch it off later in Settings without leaving the directory.

  • It is built only from your own material, and runs through the same check described in section 5.
  • Your master résumé itself is never handed to a recruiter, and neither are your contact details or private salary floor.
  • We keep a record of which recruiter generated a tailored CV against which role, and you can see it. Withdrawing the permission, or leaving the directory, stops any new one immediately.

7. The directory

Being listed is opt-in and reversible. You choose whether to be listed at all, and how visible you are. You can withdraw at any time, and we will stop showing you to recruiters. Copies a recruiter has already downloaded or saved are outside our control — that's a normal consequence of sharing, and worth bearing in mind before you list.

8. If you use the service as a recruiter

Candidates trust the directory because it isn't a scraping target. In exchange for access, you agree that you will:

  • use candidate information only to evaluate and contact people about genuine roles, and not for marketing lists, resale, or building a competing database;
  • not scrape, bulk-export, or automate collection of candidate data;
  • comply with anti-discrimination, privacy, and employment law wherever you recruit — the fact that our tools rank and score candidates does not transfer that responsibility to us; and
  • keep what you learn confidential and delete it when you no longer have a legitimate reason to hold it.

We may suspend recruiter access immediately if we reasonably believe this section has been breached.

9. Plans, credits, and payment

  • Subscriptions renew automatically each month at the price shown when you subscribe, until you cancel. We take payment through Stripe; we don't store your card details.
  • Credits meter the AI-heavy actions. Your plan includes a monthly allowance, and you can buy more. Credits are tied to your account, have no cash value, and can't be transferred or exchanged for money.
  • If an AI action fails, we refund the credits it cost. That's automatic — you don't need to ask.
  • Price changes apply from your next billing period, and we'll tell you before they take effect.

10. Cancelling and refunds

You can cancel any time from your billing settings. Cancellation stops the next renewal; you keep access until the end of the period you've paid for. We don't generally refund part-months or unused credits.

None of this limits rights you have under consumer law that can't be excluded — including, where it applies, the Australian Consumer Law. If the service isn't delivered as described, contact us at support@opentopoach.com and we'll put it right.

11. Acceptable use

Don't use OpenToPoach to:

  • impersonate someone, or present another person's experience as your own;
  • post unlawful, harassing, or deliberately misleading content;
  • scrape, reverse-engineer, or overload the service, or work around its limits and gates;
  • resell or redistribute the service or its output as your own product; or
  • break the law, or help someone else do so.

12. Our material

The platform itself — the software, models we build, scoring methodology, designs, and brand — remains ours. You may use the output you generate for your own professional purposes, including commercially (applying for roles, publishing your posts, sharing your CV). You may not use the service to build a competing product.

13. No guarantee of outcomes

We can help you present your experience well and put it in front of people. We can't promise interviews, offers, or hires. Scores, match percentages, and rankings are estimates produced by our models — they are a tool for prioritising attention, not an assessment of anyone's worth, ability, or suitability, and they should not be the only basis for a hiring decision.

14. Liability

The service is provided as-is. To the extent the law allows, we aren't liable for indirect or consequential loss, lost profits, lost opportunities, or lost data, and our total liability for any claim is limited to what you paid us in the twelve months before it arose.

Nothing here excludes liability that can't legally be excluded, including under consumer law.

15. Suspension and closing your account

You can close your account at any time from Settings, which deletes your data as described in the Privacy Policy. We may suspend or close an account that breaches these terms, or where we're required to by law. Where it's reasonable to do so, we'll tell you first and give you a chance to put it right.

16. Changes

We'll keep improving the service, which means features change. If we make a material change to these terms, we'll update the date above and let you know in the product or by email before it takes effect. Continuing to use the service after that means you accept the new terms.

17. Governing law

These terms are governed by the laws of New South Wales, Australia, and the courts there have non-exclusive jurisdiction. If you use the service from somewhere else, you may also have rights under your local law that these terms don't affect.
